O'Neil L. Woelke


Mr. Woelke has over 40 years experience in global trade. His practice focuses on legal, policy and enforcement issues related to global customs, export, anti-bribery and transportation laws.  For over 30 years, he worked in house as management executive and senior lawyer in international business and trade related positions at a large multinational company.  Before that, he worked in management at customs brokerage and freight forwarding company.  He is a licensed customs broker.

Mr. Woelke worked closely with government officials and counsel industry senior management during the Canada/U.S. Free Trade Agreement and North American Free Trade Agreement (NAFTA) negotiations and other free trade agreements, the drafting of the Uniform NAFTA Customs Regulations, revision of the U.S. foreign trade zone regulations, and drafting of the Customs Modernization Act legislation.  He counseled manufacturing operations in Europe on Special duty regimes and helped obtain approval for the use of a novel electronic simplified import and export reporting procedure based on the company's production systems.

Mr. Woelke has extensive experience with complicated customs compliance and valuation audits and penalty cases, successfully negotiated the use of First Sale for customs valuation in the EU and certain South American countries and successfully defending numerous customs valuation audits abroad, regulatory and legal challenges in EU member states to the use of First Sale between related parties.  He also oversaw the litigation of key U.S. customs cases in the Court of International Trade involving valuation, duty free importation of U.S. components painted and assembled abroad, and clarification of the scope of errors correctible under 19 USC 1520(c). He also has extensive experience counseling U.S. and foreign senior management on U.S. and foreign anti-bribery and export laws and related conflicts of laws, and domestic and international transportation matters.
